During the divorce process, two Decrees will be received but they have very different meanings and effects.
Decree Nisi is the first Decree that will be received, a few weeks after your Application for divorce has been issued by the Court. This Decree confirms that the Court is satisfied that the marriage has broken down irretrievably, and that the person applying is entitled to divorce. It does not end the marriage.
Applying for the Decree Absolute is the final step in the divorce process and is the Decree which legally dissolves the marriage. The person who applied for the divorce can apply for Decree Absolute 6 weeks after the Decree Nisi was pronounced but it is usually advisable to wait until you have reached a financial settlement before applying. The Absolute legally brings the marriage to an end and means that parties are free to remarry.
