International abduction cases

The international movement of children unilaterally by one parent can be a very contentious and highly emotive issue. Seek our specialist legal advice as quickly as possible should the threat of abduction arise.

Dealing with the emotional and legal challenges

Sometimes parents make decisions on behalf of their children to relocate to a different country without proper consideration of the immense emotional impact upon the other parent and upon the children themselves.

It is the serious implications for those children that have given rise to international agreements to prevent such actions, or to remedy them if they occur. These are known as The Hague and European Conventions on Child Abduction. Many countries are signatories to one or both and agree to cooperate in the regulation and enforcement of them. These provide an international legal framework to secure the relatively swift return of children who have been wrongfully removed from their country of residence.

The position where children have been wrongfully removed to a country which is not a signatory is far more problematic, and parents are often left to attempt to secure a remedy under the laws of that country which can be fraught will difficulty.
