Settlement following a negligent failure to triage correctly in A&E

John Coulson acted for a young woman who collapsed in the street with acute abdominal pain. Although she was quickly taken by ambulance to hospital, there was a failure to triage her correctly in A&E, resulting in a delay in a senior level consultant undertaking a review. The client was admitted to hospital for management of her pain with suspected appendicitis. 

When a senior review eventually took place the following morning, a belated CT scan revealed an ovarian torsion. Our client underwent surgery later the same day when it was discovered her ovary had ruptured and she had extensive blood loss. During the operation her ruptured ovary and fallopian tube were removed.

The 24 hour delay in admission to surgery resulted in permanent loss of an ovary. In addition, the client suffered from exhaustion and suffered psychologically with low mood, for which she had counselling. During her recovery post discharge, the client needed help from family members in looking after her son.

John Coulson obtained expert evidence in the case that stated that if the client’s condition had been diagnosed correctly without the delay then she would have avoided the removal of one of her ovaries, the internal bleeding, the need for the blood transfusion, the pain and suffering whilst on the ward, and would have made a quicker recovery.

As a result of the removal of the ovary; whilst this did not necessarily have any impact on ou client’s fertility at the moment, if there was to be a problem with her remaining ovary, then any subsequent infertility would be due to the hospital’s negligence.

The NHS Hospital Trust accepted mistakes were made. A settlement was achieved which included compensation for the assistance given by family members in looking after the client and her son.
